Terms of use for businesses
Last updated: 25 October 2026 · version 2026-10-25
This is a translation of the Spanish original. If there is any difference between versions, the Spanish version prevails.
These terms govern the use of Fidelizando by businesses (hereinafter, «the business»). The business accepts them when creating its account. Together with them it accepts the data processing agreement, which governs its customers’ data.

2. Professionals only
Fidelizando is a service for companies and professionals, who contract it for their business activity. When creating the account, the business declares that it is acting as a professional. For that reason the consumer right of withdrawal does not apply; instead, it has a 14-day free trial and can cancel whenever it wants, with no commitment.
3. The service
Fidelizando lets the business create loyalty cards for Apple Wallet, Google Wallet and its own web app, manage its customers, add stamps and redeem rewards, and send them notifications and campaigns. Features depend on the plan.
4. Account and access
The business is responsible for the accuracy of its account details, for keeping its passwords safe and for what the members of its team to whom it gives access do.
5. Proper use of its customers’ data
- The business is the controller of its customers’ data and must have a legal basis for each use: the card and its notifications are based on the service the customer requests; offers, on their express consent.
- Offers and marketing communications: only to customers who have ticked the offers box or given their consent in another demonstrable way (in the UK, the PECR; in the EU, the national ePrivacy rules). Every email includes one-click unsubscribe and Fidelizando does not send offers to anyone who did not accept them.
- Importing customers: only those who gave permission to store their data, and marking as «accepts offers» only those who really accepted. The business declares it has this when importing and must be able to prove it.
- Dealing with its customers’ rights (access, erasure, unsubscribing from offers…). The dashboard lets it download and delete their data.
- Not using the platform to send unsolicited communications, unlawful or misleading content, or special categories of data (health, beliefs…).
- Complying with its country’s rules on promotions, prize draws, prices and advertising in its sector.
6. The business’s content
Logos, photos, texts and promotions belong to the business, which guarantees it has the right to use them and is responsible for the promotions and rewards it offers. It authorises us to display them on its card, its app and, if it enables it, in the Fidelizando marketplace.
7. Plans, payments, taxes and cancellation
Paid plans are taken out from the dashboard, with a 14-day trial and no card needed. Prices are shown excluding VAT and are charged in advance (monthly or yearly) through Stripe. Invoices are issued by Javier Arenillas (3CWeb) and are always available in the dashboard. Businesses established in Spain are charged Spanish VAT; businesses in another European Union country with a valid VAT number are invoiced without VAT under the reverse charge mechanism; businesses outside the European Union are invoiced without Spanish VAT (any local tax is their responsibility). The business can cancel at any time, with no commitment: the plan stays active until the end of the paid period and the unused part is not refunded. On cancellation, its customers’ data stays stored so it can download it or reactivate the account; we delete it when asked, within 30 days at most, except what must be kept by law.
8. Availability and liability
We take reasonable measures so the service runs without interruptions, but we are not liable for interruptions beyond our control (including changes or outages at Apple, Google or Stripe) or for misuse of the platform. Except in case of wilful misconduct or gross negligence, our liability is limited to the amount paid by the business in the last 12 months.
9. Suspension
We may suspend an account that breaches these terms, especially if it sends communications without consent or does not pay, after notifying the business whenever possible.
10. Changes
If these terms or the processing agreement change, we will give notice in the dashboard in advance and ask the business to accept the new version. If it does not accept it, it can cancel without penalty.
11. Languages, governing law and jurisdiction
These terms are published in several languages; if there is any difference, the Spanish version prevails. Spanish law applies. As the business contracts as a professional, the courts of Madrid have jurisdiction.
